Constitutional property rights are assaulted in proposed moratorium ordinance.

Jeff Gaastra, president of the Newberry Springs Recreational Lakeowners
Association, is interested in a proposed ordinance similar to one long promoted by Ellen Johnson,
president of the Newberry Springs Area Property Owners Association, that would limit property
owners rights. Holly Shiralipour, District Conservationist for the Natural Resources
Conservation Service of the USDA reportedly suggested to Gaastra that he form a local committee
to address his concern. The wording of the draft ordinance was reportedly prepared by
an employee of the Mojave Water District. The proposed ordinance appears to lack community
support.
Proposed New County Ordinance
Note: This proposed ordinance will require a full CEQA review. This is NOT a sudden
Urgency Ordinance matter. The water overdrafting has been developing for over 50 years and
the proposed ordinance will have a severe impact upon the economic development of Newberry Springs
that is an economic disadvantaged area. The hardest hit segment of the population will be
the general residents and not the higher income lake owners nor the wealthy farmers who together
are responsible for over 80% of the water basin's depletion.
