Members from the San Bernardino County Sheriff's Department Marijuana
Enforcement Team, the California National Guard Counterdrug Task Force, and the San Bernardino
County Land Use Services Department conducted investigations resulting in the service of 8 search
warrants and at least one follow up contact at locations in the unincorporated areas of San
Bernardino County, in the communities of Newberry Springs and Daggett.
The locations were found to have marijuana cultivations or commercial
marijuana activity occurring on them that are prohibited by the county's Commercial Cannabis
Ordinance. San Bernardino County recently enacted a new marijuana ordinance to be
consistent with the Medical Marijuana Regulation and Safety Act or MMRSA that went into effect
on January 1, 2016. The investigations revealed all of the marijuana cultivation operations
were illegal and not in compliance with California medical marijuana laws and/or the County of
San Bernardino ordinance prohibiting commercial cannabis activity and/or cultivation of marijuana.
The investigations resulted in total seizures of over 3,700 marijuana plants
and over 50 pounds of harvested/processed marijuana. One suspect, Thanh The Dies, was
arrested and issued a citation release at the scene for violating the San Bernardino County
ordinance. He will appear in court at a later date. Investigators did not find
any other suspects at the other locations and are in the process of identifying them.
Once identified, they will be charged with violating the county's ordinance or for cultivation
of marijuana, a felony.
The California National Guard Counterdrug Task Force provides support
to law enforcement agencies and community based organizations. They are comprised of
members of both Army and Air National Guard. The San Bernardino County Sheriff's
Department will use resources like the National Guard Counterdrug Task Force in an effort
to combat these illegal marijuana cultivations in our desert areas.
The County of San Bernardino modified its marijuana ordinance to reflect
Commercial Cannabis Activity as described in the Medical Marijuana Regulation and Safety Act.
The continued County wide prohibition of commercial cannabis activities will be maintained to
ensure for the health, safety, and well-being of County residents against any potential criminal
activity or adverse impacts on the County. San Bernardino County Code Enforcement personnel
assisted with the investigations for administrative enforcement of any county ordinance
violations. The Sheriff's Gangs/Narcotics Division will continue to enforce California
marijuana laws as well as the San Bernardino County ordinance regarding commercial cannabis
activity. Persons found to be violating state marijuana laws and county ordinances are
subject to fines, prosecution, and seizure of property.
